Terms of Use

DEFINITION OF TERMS

This Agreement governs your use of the EON App provided to you by Union Bank of the Philippines (“Eon” or the “Bank”) located at Eon Plaza, Meralco Ave. cor. Onyx and Sapphire Roads, Ortigas Center, Pasig City, Philippines. Please read it carefully so that In these Terms and Conditions:

  •  "EON App" refers to Eon’s EON mobile app and internet banking service which may also be referred to as "Facility"
  •  “EON App Services” refers to the various financial transactions such as but not limited to balance inquiry, fund transfers, pay bills or buy load performed by customers through the EON App.
  •  "Account" refers to the EON account held with Eon in your name.
  •  "We", "Us", "Our", "EON", "Bank" refers to Union Bank of the Philippines.
  •  "You" and "Your" refer to the owner of the account.
  •  A "Mobile Phone" refers to the client’s cellular network phone unit with the client’s subscriber identity module (SIM) card and corresponding 11-digit mobile number assigned to the SIM card.
  •  "One-Time Password" or "OTP"refers to the six-digit code sent to the user’s registered mobile number or generated through Eon Online app or Eon website needed for two-factor authentication of the user.

  1. ACCESS TO ACCOUNT
    1. You may access your Accounts by registering in the EON App using your EON App.
    2. Upon registration, you must provide the required account information. By registering with the EON App, you warrant that all the information you provide are true, complete and up to date. You acknowledge that your nominated e-mail address and/or mobile phone number maintained in the Bank's records are active and valid and shall be where all enrollment, password-related information, and other online correspondences will be sent by the Bank. The Bank, at its sole discretion, reserves the right to validate the information provided by you through the mobile app or customer service. Once your information has been validated, you will receive a confirmation from the Bank through short message sending (SMS) and/or electronic mail (email).
    3. Your Online Banking Services are permitted only after validation of the information you provided us and authentication of your identity through various two-factor authentication methods. Your instructions made after such validation and authentication shall be the authority of the Bank to carry out the banking transactions performed by you through the facility. The Bank shall have no obligation to verify the authenticity of any transaction received from you through or purporting to have been by you via the Eon Online App and Internet Banking other than by means of verification of your
    4. mobile number through the OTP sent, your user ID and password, or through biometric authentication methods such as but not limited to fingerprint scanning, facial recognition or retina scan.
    5. Your enrolment to the facility will be effective upon your receipt of the Bank's confirmation of the enrolment of your accounts through SMS and/or email and will remain in full force and effect until we receive from you a written notice of its termination.
    6. The application and website may be utilized anytime except for when we are undergoing system maintenance and if the Bank notifies you of the unavailability of our Online Banking Services.
  2. ONLINE BANKING PASSWORD SECURITY
    1. You shall keep your User ID, password, account numbers and other account data confidential and secure at all times.
    2. You agree to assume full responsibility and liability for all transactions made in your accounts through the use of the facility. It is understood that the password is known only to you and as such, any transaction effected using your password and/or OTP shall be conclusively presumed to be done by you or authorized by you.
    3. You agree that the Bank, at its sole discretion, is entitled to act on the instructions received from you through the facility after the correct entry of your User ID, password and/or OTP, or your other biometric authentication methods such as but not limited to fingerprint scanning, facial recognition and retina scan. You further agree that the Bank shall not be liable and you agree to indemnify the Bank for any loss, damages or costs the Bank incurs for acting in accordance with or based on requests/instructions received through Eon Online, which we believe emanates from you.
    4. As a safety measure, you further agree and undertake to change your password from time to time as you deem necessary. If you believe that your mobile phone or password may have been lost/stolen or that someone has used it without your permission, you shall notify the Bank immediately and shall give the latter a reasonable period to de-activate your compromised Eon Online User ID and password. The Bank is not responsible for any loss, damages or costs which you may incur resulting from the loss of your mobile phone or password, or the fraudulent transactions which may occur if you do not notify the Bank that your mobile phone or password may have been lost/stolen or that someone has used it without your permission.
    5. You must keep your password totally confidential and secure at all times and not to reveal it to any third party.
    6. When changing your Eon Online password, choose a password which must not relate to any readily accessible data such as your address, telephone number, driver's license, date of birth etc. and easily guessable combination of numbers. Do not let any unauthorized person have access to your mobile phone or leave your mobile phone unattended while accessing the mobile banking application.
    7. You acknowledge that the OTP is an added security feature that requires you to enter a unique 6-digit password for your online transactions and help the Bank authenticate your identity. The Eon app does not allow deactivation of your OTP for your safety.
  3. SERVICES
    1. Balance Inquiry. You may view the account balances of your enrolled Eon accounts. The account dashboard screen contains all your accounts with the enrolled accounts in the facility. With the exception of those you have hidden through the application or through a documented request.
    2. Add Money. You may add money to your account through your other account or third-party account within Eon and from other local banks;
    3. Send Money. You may send money from your own account/s to your other accounts or third-party accounts within Eon, to other local banks and other remittance partners; provided. that: there are sufficient funds available in your account; (b), the information provided are complete, correct and valid;, and (3) that transactions are within the allowable limits set by the Bank or you as the user. You hereby agree that all fund transfers initiated through Eon Online shall be subject to such transaction limits, cut-off periods, service fees, and other policies that may be imposed by the Bank and by the relevant electronic funds transfer service provider or network such as, but not limited to, InstaPay and PESONet. The Bank will affect such mobile fund transfer transactions provided there are sufficient funds available in your account, the information provided are complete, correct and valid, and that transactions are within the allowable limits set by the bank or you as the user. The Bank shall not be liable for any omission to make all or any of the payments or for late payments due to circumstances beyond the reasonable control of the Bank. The Bank shall likewise not be liable for losses, costs or damages for failed or incorrect fund transfers resulting from an error or omission in the information you provided us with.
    4. Pay Bill. You may pay your bills from your deposit account(s) to institutions with which the Bank has collection arrangements. There is no enrolment required for this service. If the payment is made on Saturday, Sunday or holiday, your account shall be debited for the payment amount on the same day and the institution advised of such payment on the next banking day. The Bank shall not be liable for any omission to make all or any of the payments or for late payments due to circumstances beyond the reasonable control of the Bank.
    5. Buy Load & Top Up. You may buy load and top up from your enrolled deposit accounts to your own mobile number/account and to other user-identified mobile numbers/other accounts for the Telecom load (GLOBE, SMART, and SUN networks), and gaming load. There is no enrolment of mobile numbers/accounts required for this service. The denominations available for each network/game are subject to their availability with the electronic load vendor. Your account shall be debited for your load purchase the same day as your buy load/top up request was received by the Bank. You understand that all buy load transactions are subject to the availability and reliability of your telecommunication network connection, the electronic load vendor receipt of transaction request and load denomination availability.
    6. Managing your card and account. You may manage your EON account in the app without the need to visit a branch or a store.
  4. CALL EON SUPPORTYou may call the Bank for inquiries or, concerns about or to report unauthorized transactions in Eon application email us at heretohelp@eonbankph.com.
  5. ACCURACY OF INFORMATION
    1. The Bank will use reasonable efforts to ensure the accuracy of information accessed through the facility but does not warrant the information will be free from error. If you notice an error in the account information supplied to you through the facility or by the use of any of the facility’s services, you shall advise the Bank as soon as possible. The Bank will endeavor to correct the error promptly and adjust any interest or charges arising out of the error.
    2. The Bank accepts no liability for the consequences arising out of erroneous information that may have been supplied by you through this facility. Hence, you are solely responsible for the correctness of the information that you supply to the Bank through the use of the facility or through any other means such as electronic mail or written communication. If you suspect that there is an error in the information supplied to the Bank, you shall advise the Bank as soon as possible. The Bank will endeavor to correct the error wherever possible on a "best efforts' basis".
  6. PRIVACY POLICY – Please read the Privacy Policy also found in this App to understand how we use and process any information you give us and to know your rights as a data subject.
  1. ADDITIONAL FEATURES AND SERVICES
    Eon may, from time to time, introduce new internet banking features and services. We will inform you of these new features and services. These Terms automatically apply to your use of these new features and services. By using these features and services when they become available, you agree to be bound by the Terms and Conditions that will be made available to you concerning these features and services.

    Eon does not guarantee the continuous availability of all internet banking services mentioned in this Agreement. Eon reserves the right to terminate or suspend, in its sole discretion, any of the services and features in the App.
  1. LIABILITY
    Eon shall not be liable for any loss or damage of whatever nature in connection with the implementation of transactions coursed through Eon Online in the following instances:
    1. Disruption, failure or delay relating to or in connection with the facility and/or it’s services which are due to circumstances beyond the control of the Bank, unforeseen events, fortuitous events such as but not limited to prolonged power outages, breakdown in computers, software, operating systems and telecommunication facilities, typhoons, floods, public disturbances and calamities and other similar or related cases.
    2. Loss or damage arising out of any fraudulent access or utilization of the facility due to (1) theft; (2) unauthorized disclosure of mobile phone numbers, emails, passwords; (3) deactivation of the OTP; and (4) unauthorized usage of biometrics and other security measures used in the facility with or without your participation.
    3. Inaccurate, incomplete or delayed information is received due to disruption or failure of any information or communication facilities used in the facility or due to faults in the telecommunication network, internet or network failure, or software or hardware error beyond the control of the Bank.
    4. Any indirect, incidental or consequential loss, loss of profit or damage suffered by reason of the use or failure or inability to use the facility.
    5. Any and all liability, costs, damages, losses and causes of action arising from or in any way connected with the disclosure of information concerning your accounts and/or transactions with the Bank to unauthorized persons for any reason whatsoever, including but not limited to wiretapping of communication lines or erroneous connection by telecommunication switches, or errors in transmitted information due to faulty lines, and any and all forms of high technology surveillance or fraud.
    6. Any incidental or consequential loss, loss of profit or damage arising from the loss of your mobile phone, mobile devices and other electronic devices enrolled to Eon Online.
  2. SERVICE CHARGES AND TAXES
    1. You agree to pay the charges that may be imposed by the Bank when availing of services and/or products under this facility and the standard SMS and call rates that will apply by using this facility. We will deduct the charges directly from your account balance as these are incurred. We are not responsible for the monitoring of your mobile phone charges. It is your responsibility to monitor these charges and to ensure that you have enough mobile credits to transact using this facility. We will not be liable for dishonor of other debits to your account resulting from our deduction of any charges as authorized by your acceptance of these Terms.
    2. You are also responsible for paying any and whatever taxes due or may be imposed upon arising from availment of the App. You authorize the Bank to automatically charge or debit your deposit account for any and all such taxes due and required to be withheld by the Bank.
    3. We reserve the right to change the charges, fees, or other terms described in these Terms and Conditions. When changes are made and/or fees, charges or other material terms are added we will update this Terms and Conditions, and either send a notice to you at the address shown on our records or send you an email.
    4. You agree to be responsible to check the website from time to time, for any updates to these Terms and Conditions and you further agree that your continued use of the EON App after any of the changes to the Terms and Conditions take effect will constitute your consent and adherence to such changes.
    5. As always, you may choose to decline changes by discontinuing the accounts or services to which these changes relate but charges already incurred shall remain due from and payable by you. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees for individual situations.
  3. TERMINATION OF THE AGREEMENT
    1. You may request for termination of the EON App by placing a request through our Customer Service email and giving the Bank at least ten (10) banking days to process the request. You shall remain responsible for any transactions made on your account/s through the service prior to the time of such cancellation of the Eon Online service.
    2. The Agreement comprised in these Terms and Conditions shall be deemed to remain in full force and effect if and in so far as any transaction is completed but not debited to your account/s prior to termination of the service. Also, termination of the Eon Online facility shall not prejudice your liability in respect of things done or omitted to be done prior to termination thereof.
    3. The Bank may, for security and other reasons, withdraw the EON App services anytime you are given reasonable notice under the circumstances. If the service is erroneously or negligently withdrawn by the Bank for any reason other than your breach of the terms and conditions hereof, the Bank's liability shall be restricted to the return of the annual charges, if any, recovered from you for the period in question.
    4. The closure of all your accounts enrolled on the service will automatically terminate the service.
    5. The Bank may suspend or terminate your EON App service with notice if you breach any of the terms and conditions hereof or the Bank learns of your death, bankruptcy or lack of legal capacity.
  4. MISCELLANEOUS
    1. These terms and conditions and the banking practices and charges relating thereto may be changed by the Bank at any time by notice to you. Any such changes will be effective from the date of the notice or such later date as may be specified therein. The Bank shall endeavor to post such changes in its website at www.eonbankph.com .
    2. Should the Bank become involved in any litigation which may have relation with this Agreement, or with any of the rights, powers and remedies hereunder, all fees and expenses incurred by the Bank in such a litigation, including a reasonable amount for the attorney's fees which amount is hereby agreed to be at the rate of 10% of the sum sought, shall be paid by the you.
    3. This Agreement is governed by the rules and regulations of Bangko Sentral ng Pilipinas and applicable laws of the Philippines relating to the covered transactions herein. It shall be understood that access to and use of the service shall be subject to applicable requirements and procedures of government telecommunications or other regulatory authorities and those prescribed by law.
    4. The venue of all legal actions or proceedings arising out of or in connection with these Terms and Conditions shall be brought only in the proper courts of Pasig City to the exclusion of all other venues.
